2026 Middle School Mock Trial Questions
Question: Exhibit 11 was created by Emerson Swift, but in tehir affidavit it is not listed as an exhibit they reviewed. Although Swift's affidavit aligns with what is said in the report, this exhibit can not be entered as evidence. Is that omission by design?
Answer: LRE will amend the affidavit of Emerson Swift to reference Exhibit #11 directly. Please note if a team can lay the proper foundation, then a team may seek to admit Exhibit #11 through Emerson Swift or any witness, just like any other exhibit. Rules of Evidence do not specifically require an exhibit to be referenced in an affidavit before it could be admitted.
Question: On Exhibit #1, 14 lines down, the timestamp for the EMS arriving on scene and the dispatch time confirmed on scene do not match. The same is true for the NCPD unit arriving. Is this intentional?
Answer: No. The timestamps were incorrect in the confirmation of arrival times. The case materials have been updated to correct this error. The corrected version is available on the website.
