Based on the best-selling novel, Medicare Issues in Liability & Workers' Compensation Settlements, this seminar will provide insights on how to best consider Medicare's interests when settling liability and workers' compensation claims. Learn about topics under the Medicare Secondary Payer (MSP) Act, including verification of Medicare conditional payment liens; recent and anticipated changes under the SMART Act; private causes of action to enforce reimbursement on behalf of Medicare; exposure under the False Claims Act arising out of MSP obligations; how to determine if an MSA is needed in a settlement; whether it is ever required to submit a settlement to the Centers for Medicaid & Medicare Services (CMS); settlement options available exclusively to liability or workers' compensation claims, but not to both; proposed (but withdrawn) rules for liability settlements and what we may expect from CMS in the future; and suggested language to include in liability and workers' compensation settlements.
