DHEC-CO/COS seeks to fill the position of Environmenetal Affairs Attorney III. The Office of General Counsel ("OGC") is the legal team for the South Carolina Department of Health & Environmental Control (Department" or "DHEC"), providing representation and legal advice on a wide range of highly important state issues. 

Job Responsibilities

 Under limited supervision of the Chief Counsel for Environmental Quality Control (EQC):

  • Provides legal representation, both independently and in collaboration with other EQC attorneys, to the Bureau of Air, Bureau of Environmental Health, Bureau of Land and Waste Management, and the Bureau of Water (“Bureaus”).

  • Represents the Bureaus in meetings and negotiations and in responding to inquiries from the public, the regulated community, and opposing legal counsel.
  • Represents the Bureaus before the DHEC Board and in litigation before the Administrative Law Court and other state and federal courts. Representation includes but is not limited to: drafting pleadings, motions, briefs, and other litigation documents; conducting and responding to discovery requests; taking and defending depositions; managing exhibits; preparing witnesses; presenting oral arguments; conducting trials; and settling actions. 
  • Provides legal advice and counsel to program directors, administrators and staff in the areas of permitting, compliance, and enforcement.  
  • Assists in the development of agency regulations, standard operating procedures, and policy documents as needed.
Minimum and Additional Requirements

State minimum requirements:

  • A juris doctor degree or its equivalent from an accredited law school and experience as a practicing attorney.

Agency additional requirements:

To qualify as a candidate for this position you must:

  • Be an active member in good standing with the South Carolina Bar.
  • Have at least two years' experience as a practicing attorney. 
  • Possess a strong working knowledge of the laws of South Carolina, with the ability to interpret and apply federal and state laws, regulations and judicial decisions. 
  • Possess excellent written and oral communication skills, with the ability to explain legal issues in simple, direct and easily understandable terms. 
  • Possess both strong organizational skills with a demonstrated ability to work independently and strong interpersonal skills with the ability to work in a team environment.  Files must be maintained in an organized manner and regular communication with other EQC attorneys and support staff is required.
  • Demonstrate strong legal research and writing skills, with the ability to conduct legal research and draft legal opinions and memoranda. A resume and legal writing sample must be submitted with your application as an addition to, and not as a substitute for a for, a completed application. 
  • Possess a working knowledge of common office software and legal research programs. 
  • Possess a commitment to professionalism, ethics and public service. 
  • Must be agreeable to occasional work outside normal business hours and occasional overnight travel.
  • **Candidates must specifically meet the Agency Additional Requirements or demonstrate an equivalent combination of education and experience to be considered for this position.​​
Preferred Qualifications

The following qualifications are preferred, but not required:

  • Experience in environmental law and/or administrative law.
  • Completion of Rule 403 trial experience requirements.
  • A minimum of one (1) year litigation experience.
  • Documented completion of The Lawyer Mentoring Program established by Rule 425, SCACR.
