The position is located at the Department of Mental Health, Central Office, 2414 Bull Street, Columbia, SC 29201 within the Department's Office of General Counsel.

Under the supervision and training of a Senior Attorney, handle SCDMH debt collection and liens against patient estates and property in probate courts, including negotiating with courts and parties. Advise SCDMH Reimbursement staff regarding collections and related legal procedures. Under the general supervision and training of a Senior Attorney, represent SCDMH in Foreclosure and Bankruptcy (limited and infrequent) actions. Under the general supervision and training of a Senior Attorney, assist with Corporate Compliance legal matters, including Medicaid and Medicare reimbursement standards and appeals.

Under the supervision and training of a Senior Attorney, review, approve, and monitor contracts for medical providers, leases, and contracts for the operation of healthcare facilities and third party payers. Advise SCDMH staff on compliance and development of contracts.

Infrequent (once a month or less) instate travel to hearings, usually during normal working hours (8:30 am – 5:00 pm). No overnight travel anticipated.    

Minimum and Additional Requirements:
State Requirements: A Juris Doctor degree or its equivalent from an accredited law school.

Agency Requirements:
A Juris Doctor degree or its equivalent from an accredited law school
Member of the South Carolina Bar
Good verbal and written communication skills, with an emphasis on attention to written details
A valid motor vehicle driver's license
A writing sample of 1-3 pages

Preferred Qualifications:
Completion of Trial Experiences as required by South Carolina Rules of Appellate Procedure Section 403
One or more years as a practicing attorney for a South Carolina or other public agency
Experience in probate or collection matters
Experience in contract matters
