A conference call was held on October 9, 2007, at 8:30 a.m.

CALL TO ORDER: Mr. Lucey called the meeting to order.
 
MINUTES: A motion was made for approval of the September 12, 2007, Minutes. The motion was seconded, and the Minutes were unanimously approved.
 
UPDATE REPORT ON ORGANIZATION OF SECTION SOCIAL IN COLUMBIA:
Ms. Way reported invitations had been mailed out to Section members with approximately 35 confirming attendance thus far. Ms. Phelan reported the Section roster had been divided among the subcommittee, Ms. Elliott, and Ms. Way to make personal contact in an attempt to increase attendance.
 
It was determined there would not be a receiving line at the social. It was also determined that members of the judiciary as well as those scheduled to participate in the Elder Law CLE on October 19th would be invited. Ms. Way would take care of organizing extending invitations and would notify the Clarion of expected attendance on or before October 16, 2007.  
 
OLD BUSINESS:
 
A. Report on status of survey subcommittee: Mr. Lucey reported the subcommittee was in the process of finalizing proposed amendment language regarding petition for rehearing prior to filing a petition for certiorari. Once the language was finalized and approved by Allyson Haynes, Civil Procedure Law Professor with the Charleston School of Law, the language would be circulated to Council for discussion at the next scheduled conference call and then submitted to the House of Delegates.
 
B. Update report on 2008 SC Bar Convention CLE: Mr. Lucey reported Judge Young had recently been added to speak on issues relating to the trial of complex cases. There would be a panel presentation with questions opened to the floor. Mr. Lucey would soon be meeting with Judge Young to cement details. 
 
C. SC Bar Radio Segment Request: Mr. Watkins reported participation was planned for the week of December 3, 2007, and that volunteer segment plans were being firmed up with one of the segments to deal with differences between trial and appellate advocacy.
 
D. Discussion on requested feedback for South Carolina Lawyer: Mr. Boozer reported he had spoken with Ms. Way and Mr. Clemons and Ms. Way had distributed an email via listserv requesting Section members draft an article or offer topic suggestions for Mr. Boozer to draft an article. He reported Section member Lightsey had previously prepared an article on “Do’s and Don’ts of Appellate Briefs” and would be submitting it for use pending copyright clearance. Mr. Boozer reported the drafts deadline date was December 21, 2007.
 
NEW BUSINESS: Mr. Young stated he would like Council to consider forming a subcommittee of persons to fill out answers to frequent questions related to trial and appellate advocacy. Mr. Young had been asked recently how to appeal in a probate matter. He suggested the subcommittee be comprised of point persons with experience in certain areas of law, i.e. civil, criminal. Mr. Lucey stated he thought this would be a good service to provide and agreed to serve on the subcommittee. It was determined Mr. Young would serve as Chair, other volunteers would be sought, and the matter would be on the agenda for the next meeting.
 
NEXT MEETING: It was determined the next meeting would be a conference call on November 6, 2007, at 8:30 a.m.
 
ADJOURNMENT: There being no further business, the meeting was adjourned.
