TRIAL & APPELLATE ADVOCACY SECTION COUNCIL MINUTES
April 11, 2007
There was a conference call of the Trial & Appellate Advocacy Section Council on Wednesday, April 11, 2007, at 9:00 AM.

CALL TO ORDER: Mr. Young called the meeting to order.
MINUTES: Mr. Young asked for approval of the March 14, 2007 Minutes. Mr. Moore made a motion for approval. The motion was seconded and the Minutes were unanimously approved.
OLD BUSINESS:
a. Legislative Report: Mr. Lucey was not present. Mr. Young reported that the Federal Senate Judiciary Committee approved the John Justice Loan Forgiveness bill. The bill would provide education debt relief for public defenders and prosecutors and would next go to the full Senate. The John R. Justice Prosecutors and Defenders Incentive Act (S. 442) would authorize up to $10,000 per year in federal loan repayment assistance for those who agree to remain public defenders or prosecutors for 3 years. Companion legislation (H.R. 916) had been introduced in the House; the House committee vote was preceded by a full committee hearing.
b. Co-Sponsoring CLE with SC Bar: The option of the Section collaborating with the South Carolina Bar and the South Carolina Association of Certified Public Accountants to sponsor a litigation conference to be held September 21-22, 2007, at Kiawah Island was discussed. Mr. Young reported the following:
1. If the Section co-sponsored the CLE, there would be a $50.00 discount for Section members.
2. The Section would gain exposure as it would be added to the program/flyer as co-sponsor.
3. The option of utilizing part of the CLE to do a Web or teleconference at a later date following the event would require the authorization of keynote speaker, Roger Dodd. Terry Burnett had contacted Mr. Dodd regarding an agreement whereby the Section would not pay royalties and/or licensing fees. Mr. Burnett was waiting for Mr. Dodd’s response.
4. The Association of CPAs had not responded to Mr. Burnett as to whether they were sponsoring a reception or if they would allow the Section to sponsor a reception. Mr. Young stated he did not think the social was likely as the Association of CPAs was the lead sponsor. Mr. Moore moved to go forward with this litigation conference considering Mr. Young’s report and prior discussion wherein:
a. Focuses of the conference would be computer forensics and federal rules of civil procedure in ESI cases.
b. A number of local judges would speak, as would Mr. Dodd, who would do a three hour presentation on cross examination.
c. The Section would help defray the expenses, including the keynote speaker’s $5,000 honorarium, plus travel, meals and lodging expenses. The approved contribution was $2,500.
d. If the Section were to conduct a reception, the spring socials would be cancelled this year.
Mr. Moore’s motion was seconded. There being no further discussion, the motion was unanimously approved.
5. Spring Socials:
Upstate: Jacqueline Austin
Midlands: Salley Elliott
Pee Dee/Coastal: Hervery Young
Lowcountry: Vernon Glenn
Mr. Young stated that the socials would be a time for the members to fellowship. Ms. Austin nor Mr. Glenn were present to report ideas. Ms. Elliott stated she had requested Ms. Way to provide her with some locations/contact information for the Midlands and that Ms. Elliot would send this information out via email. It was discussed the social would probably be held in the afternoon and about 75 people would need be planned for.
Mr. Young stated Mr. Glenn had previously said he would possibly host a social at his home. Mr. Young also mentioned that the Holiday Inn West in Conway could easily accommodate providing food/bar for approximately $1,000.00. Also, Myrtle Beach has a minor league baseball team that they could possibly attend. He had checked on this and they could accommodate an “All you can eat/drinks” to include beer for $15-$20 per person (also includes ticket to game). Alternatively, they had the option to just purchase tickets for the game and reserve an area to sit for $8 per person. The River Dog was also discussed.
Mr. Young stated he would get information out by the end of April for all the areas. He stated the council members would not have to attend all the socials; but should attend at least a few in their area.
6. 2008 SC Bar Convention CLE: Mr. Young reported that he had contacted Mike Kelly and Terry Burnett regarding co-sponsoring a civil law update. Mr. Kelly agreed to partner with the Section and spearhead the initiative. Mr. Young stated he would speak with them in a conference call the following week and would share ideas and ask council members to be contacts for Mr. Kelly for interaction on CLE, including presentation and other matters.
7. Other – Status of Survey Subcommittee: Mr. Young asked Mr. Forman if the Subcommittee had met. Mr. Forman reported that it had not. Mr. Young stated that he would follow up with Mr. Lucey.
NEW BUSINESS:
a. Rule 43(k) – Mr. Young reported that several Bar entities were interested in revising Rule 43(k), SCRCP. Ms. Brown informed the Council that the contact person was Mike Glenn, who is on the ADR Section Council. Mr. Young volunteered to call Mr. Glenn to find out how the Section could contribute.
NEXT MEETING: The next meeting would be held on May 9, 2007, at 9:00 AM and will be a conference call.
