SC BAR

The Real Estate Practices Section Council met this date via conference call. Participating members were Robert L. Buchanan Jr., Charles Hedgepath, William O. Higgins, Robert W. Lowman Jr., Lynn G. Stevens and Donald B. Wildman. Representing the Bar staff was Tara Smith.

 

Chairperson Lowman called the meeting to order.

 

The first item of business was discussion on the spring Section CLE. Mr. Lowman announced that the Section was to host a seminar on May 12, 2006, at the USC Law School. He welcomed feedback on potential topics and speakers.

The next item of business was the request from the SC Association of Realtors (SCAR) regarding standard real estate documents. Ms. Smith was to email the Council a copy of the letter and form that was submitted to the Bar. The Council expressed its concern that a standardized form would cause too much confusion. After continued discussion, Ms. Stevens volunteered to compile and compare the statewide forms and asked that the Council submit their documents to her for review.

 

Next, Mr. Higgins presented a brief overview of the subcommittee meeting with the SC Bankers Association and various other lenders. Major items of discussion included real estate ethical issues and disbursement of funds. Mr. Higgins noted that the next meeting was scheduled for February 3rd and that he and Mr. Dillingham would continue to update the Council.
