Real Estate Practices Section Council Meeting
August 2, 2005
 
The Real Estate Practices Section Council met on this date, via conference call. Participating members included Thomas L. Brooks, Anne S. Ellefson, Charles Hedgepath, William O. Higgins, Robert W. Lowman Jr., Lynn G. Stevens, M. Jeffrey Vinzani and Donald B. Wildman. Representing Bar staff was Tara Smith.
 
Chairperson Lowman called the meeting to order.
 
The first item of business was discussion of the Section FY2005-06 goals and objectives. Mr. Lowman moved approval of the following Section FY2005-06 goals. The motion was seconded and approved.
1. Continue to update members on information pertaining to seminars, legislative updates, etc., through the Section listserv.
2. Present an informative CLE program at the Bar’s annual Convention in 2006.
3. Conduct CLE seminars on commercial and residential real estate issues.
4. Monitor ongoing legislation and relevant appellate cases and report the information via the Section listserv to members.
5. Propose guidelines regarding best practices for real estate closing attorneys.
 
The next item of discussion was the Section seminar at the 2006 Bar Convention. Mr. Lowman indicated that the election to conduct a seminar form had been submitted to the CLE Division. It was suggested that up to 2 hours be devoted to ethics and one hour on commercial real estate issues. It was announced that Bill Higgins and Michael Virzi were potential speakers and that Jim Guignard had expressed his desire to speak at the Section seminar.
 
Next, Mr. Lowman reported that the Section was to host a CLE on “Hot Topics in Commercial Real Estate,” on October 21st. A residential seminar was scheduled for after the first of the year.
 
In the next item of business, Mr. Lowman discussed ways to increase participation among the Section membership. It was suggested that Ms. Smith solicit input through the Section listserv to encourage members to raise important issues/new cases related to the Section.
Mr. Wildman reported that he would focus on monitoring the best practices guidelines and would continue to inform the Council on his findings.
 
Next, Mr. Lowman announced that he was approached by the Palmetto Land & Title Association (PLTA) regarding co-sponsorship at its Unauthorized Practice of Law seminar. After much discussion, the Council welcomed suggestions for potential speaker and topics for future seminars to be considered at a later date. Mr. Lowman was to contact the PLTA on the Council’s decision.
