Family Law Section Council Meeting Minutes
February 15, 2007
The Family Law Section Council met this date via conference call. Participating members included Melissa B. Brown, Patricia L. Forbis, Martha L. Hamel, James G. Long III, Elizabeth Myrick, W. Randall Phipps, Vicki Snelgrove and C. Vance Stricklin. Representing the Bar staff was Tara Smith.
Chairperson Myrick called the meeting to order.
The first item of business was approval of the minutes from the December 21, 2006, meeting. The following statement was amended:
Next, Ms. Myrick reminded the Council of the Section CLE scheduled for Friday, January 26, from 8:30 a.m. 2:15 p.m. until 11:45 a.m. 5:30 p.m., in conjunction with the 2007 Bar Convention.
Ms. Snelgrove moved approval of the minutes as amended. Ms. Forbis seconded the motion, and it was approved.
The next item of business was discussion on the proposed amendments to Rule 21, Temporary Relief and Rule 25, Discovery, of the SC Family Court Rules. Ms. Myrick reported that she had received feedback from Judge Joseph McGowan regarding the Council’s recommendations. He noted that currently Rule 21, overrode SCRCP 6(d) and noted that the language had been eliminated in the proposed rule. After discussion, it was the consensus of the Council to make the following revisions to the proposed amendments to Rule 21:
(f) Service of Affidavits. Notwithstanding the provisions of Rule 6(d), SCRCP, affidavits filed at a temporary hearing need not be served on opposing party prior to the temporary hearing.
(g) Hearsay Statements in Affidavits.
(h) Oral Arguments.
Next was discussion on the 2007 Bar Convention. Ms. Myrick noted that the Section CLE was well attended and she thanked the Council for its participation.
The next item was discussion on the Children’s Issues in Family Court seminar scheduled for March 23, 2007. Ms. Myrick announced that the brochures had been distributed and noted that Ms. Forbis and Denise Harris were coordinating the event.
Next was discussion on the Family Law Intensive program scheduled in November of 2008. It was reported that Ms. Myrick and Ms. Brown were coordinating the event. Ms. Myrick welcomed input from the Council on potential locations. The following locations were suggested, Charleston, Greenville and Grove Park and Biltmore Inn in North Carolina. Ms. Brown was to research available locations in the coastal area.
Ms. Myrick presented an update on the Kids in the Crossfire video. She reported that the Texas Bar declined the Young Lawyers Division request to reproduce the video. Ms. Smith announced that the Bar’s Media and Technology Department had prepared a script entitled “Why Me?” She was to email a copy of the proposed script to the Council. Ms. Myrick reiterated that the video would target parents that were going through a divorce and the impact that it would have on their children.
Ms. Myrick reported that the estimated cost to reproduce the video was approximately $15,000 and that the Division was to fund the project. The projected distribution date was May 2007.
It was reported that the next Section Council meeting was rescheduled for March 22, 2007, at the Bar building.
There being no further business, the meeting was adjourned.
