Family Law Section Council Meeting Minutes
April 19, 2007
The Family Law Section Council met this date via conference call. Participating members included Patricia L. Forbis, Martha L. Hamel, James G. Long III, Elizabeth Myrick, W. Randolph Phipps, Vicki J. Snelgrove and C. Vance Stricklin. Representing the Bar staff was Tara Smith.
Chairperson Myrick called the meeting to order.
The first item of business was discussion of the 2008 Bar Convention. Ms. Snelgrove reported that she would serve as the Section CLE Coordinator and welcomed input from the Council on potential speakers and topics. She reported that the Section seminar agenda and projected expenses were due by May 18. The following topics were suggested: the psychological impact of custody decisions on children, efforts of pleas and sentencing, “Jessica’s Law,” and electronic evidence. After discussion, it was the consensus of the Council that the Section seminar focus on a variety of topics related to electronic communication. Ms. Snelgrove was to contact Steve Abrams and Dick Whiting as to their interest in speaking.
The next item of business was discussion on the Family Law Intensive Workshop. Ms. Myrick reported that Melissa Brown had compiled a list of potential dates, locations and quotes. Ms. Smith announced that the Kiawah Island Resort was available in November at approximately $200 per night per villa. Ms. Myrick welcomed feedback from the Council. Several Council members expressed interest in hosting the program in Greenville. After discussion, it was suggested that information on the Kiawah Island Resort and the Biltmore Inn be included on the list and emailed to the Council requesting their preference.
Next, Ms. Forbis presented a brief overview of the Children’s Issues on Family Court CLE that was held on March 23, 2007. She reported that the seminar was well received and that the attendees were pleased with the speakers. Ms. Forbis volunteered to serve as the CLE Coordinator for the 2008 program.
Next was discussion on the proposed amendments to Rule 21, Temporary Relief and Rule 25, Discovery, of the SC Family Court Rules and the Financial Declaration. Ms. Myrick reported that the Council’s recommendations had been submitted to Judge Joseph W. McGowan III, for consideration during the Family Court Judges Conference the next week. Ms. Hamel expressed concern that the Financial Declaration had not been distributed among the judges. Mr. Long was to confirm the distribution with Judge Vinson.
Next, Ms. Myrick reported that the Bar’s CLE Publications Director, Alicia Hutto had asked whether the Section was interested in revising the SC Family Lawyers’ Tool Kit, which was released in 2003. After discussion, the Council concluded there were insufficient substantive changes to warrant a revision at this time and expressed desire to revisit in the 2008-2009 Bar year. Ms. Smith was to inform Ms. Hutto of the Council’s decision.
It was announced that the next Council meeting was scheduled for May 17, at the Bar building.
