Employment & Labor Law Section Council Meeting Minutes
April 26, 2007

The Employment & Labor Law Section Council met on April 26, 2007 via conference call. Participating members included William H. Floyd III, Molly Hughes, Amy Y. Jenkins, Charles E. McDonald III and David Rothstein. Representing Bar staff was Tara Smith.

Chairperson Jenkins called the meeting to order.

The first item of business was approval of the minutes from the January 10, 2007, meeting. Mr. McDonald moved approval of the minutes. Mr. Rothstein seconded the motion, and it was approved.

The next item of business was discussion on the 2007 Bar Convention. Ms. Jenkins reported that the Section CLE was well received and that attendees were pleased with the speakers. Mr. Rothstein announced that he would serve as CLE Coordinator for the 2008 Bar Convention and welcomed input on potential speakers and topics. He informed the Council that he was interested in contacting Professor Eric Snapper of Washington, D.C. to discuss landmark cases.

Next, Mr. Rothstein reported that several solicitations for articles for the Section newsletter were distributed through the Section listserv. He opined that there were not enough articles and indicated that he had approached two law professors and several law students regarding their interest in submitting articles for future editions. It was consensus of the Council that information on the upcoming Section seminar, the NC/SC Section Annual Meeting, and deadlines and requirements for specialization credit be included in the next issue. Ms. Hughes volunteered to submit an article and other Council members agreed to solicit their firms. The next issue was to be distributed by the end of May.

The next item was discussion on the summer Section CLE. It was reported that the seminar was scheduled for Friday, June 29, 2007, at the USC School of Law. Ms. Jenkins noted that speakers were needed and welcomed input from the Council. Ms. Hughes volunteered to speak if the Section CLE Coordinator, Malissa Burnette, was unable to fill the remaining openings.

Next was discussion on the 2007 NC/SC Employment & Labor Law Section annual meeting scheduled for November 2nd & 3rd at the Doubletree Guest Suites in Charleston. Ms. Jenkins reported that Federal Judges were needed for a panel discussion and welcomed suggestions. After discussion, the following judges were suggested: Judge B. Hendrix, Judge David Norton and Judge Joseph Anderson Jr. The Council expressed its desire to distribute the registration brochure several months prior to the meeting in order to provide members adequate time to register. It was also suggested that the handout materials be provided in a binder. Ms. Smith was to relay the Council’s recommendations to the CLE Division.

Next, Ms. Hughes presented a brief update on the Section’s Specialization Committee. She noted that questions on the Labor and Employment Law Certification exam needed to be updated but that she had been unable to obtain a copy. Ms. Hughes asked that the Council email their questions or concerns.  She was to compile the Council’s recommendations and forward them to Leigh Nason for consideration. After discussion, it was suggested that the link to the SC Supreme Court Commission on CLE and Specialization be included on the Section Web page.

There being no further business, the meeting was adjourned.
