August 2007 Minutes

August 30, 2007

The Employment & Labor Law Section Council met this date, via conference call.  Participating members included Debbie Durban, William H. Floyd, Molly Hughes, Amy Y. Jenkins, Nekki Shutt, Jim O. Stuckey, II and J. Hagood Tighe. Representing the Bar staff was Tara Smith.

Chairperson Jenkins called the meeting to order.

The first item of business was approval of the minutes from the April 26, 2007, meeting. Ms. Hughes moved approval of the minutes.  Ms. Durban seconded the motion, and it was approved.

The next item of business was discussion on the 2008 Bar Convention. Ms. Shutt reported that the Section CLE was scheduled for Friday, January 25, 8:30 a.m. â€" 11:45 a.m.  She provided a brief overview of the seminar agenda.  Ms. Jenkins volunteered to coordinate the Council luncheon on Friday.

Next was discussion on the 2007 NC/SC Employment & Labor Law Update and Annual Meeting scheduled for November 2 & 3 at the Doubletree Guest Suites in Charleston.  It was reported that the Section Annual Meeting was scheduled for Saturday, November 3, at 12:50 p.m. The Council expressed concern over attendance levels and asked that it be rescheduled prior to Mr. Tighe’s presentation on Saturday.  Ms. Smith was to relay the Council’s decision to Sally Davis in the CLE Division. Ms. Jenkins volunteered to coordinate the Council luncheon on Friday, November 2. 

Next was discussion on the 2009 NC/SC Employment & Labor Law Conference.  Ms. Jenkins reported that the event would be held at the Francis Marion Hotel instead of the Doubletree Guest Suites.  She welcomed feedback from the Council regarding the relocation of the conference.  After discussion, the Council agreed that if the Francis Marion Hotel provided better rates and accommodations to proceed.

Ms. Jenkins reported that articles were needed for the Section newsletter.  Ms. Smith announced that Mr. Rothstein had approached several law professors and law students at USC but was unsuccessful.  Ms. Jenkins welcomed feedback from the Council on was to improve the newsletter.  Ms. Smith recommended that  committee chairs submit an article on the responsibilities for each committee and provide a brief update on committee activities.  Ms. Jenkins asked that the Council write or locate an article to submit.

Next was discussion on the 2008 Council nominations.  Ms. Smith reported that Council nominations for 2008 were due by November 15, 2007. It was reported that several of the committee chairs had served on the Council since 2004.  Ms. Jenkins queried whether the Section should solicit for volunteers to serve on the committees.  After discussion, Ms. Smith was to solicit for additional nominations through the Section listserv. The proposed slate would be voted on at the Section annual meeting on November 3, 2007.

Next, Ms. Hughes presented a brief update on the Section’s Specialization Committee.  She noted that only a few people submitted suggestions on how to improve and update the questions on the Labor and Employment Law Certification exam.

Ms. Durban announced that there was no new activity within the Membership Committee. Ms. Smith recommended that the Section produce a membership packet to be distributed to new Section members. Ms. Durban was to coordinate with Ms. Smith.

Next, Mr. Stuckey noted that the Education Committee was dormant and suggested that it be incorporated under the guidance of the CLE Coordinator or sunseted. He welcomed feedback from the Council. It was the consensus of the Council to table discussions until the next meeting.

There being no further business to discuss, the meeting was adjourned.
