Sign up for Lawyer-to-Lawyer Directory
The deadline to sign up to be listed in the Lawyer-to-Lawyer Directory is June 1. The directory appears in the Lawyers Desk Book and lists lawyers who have agreed to provide consultations to other Bar members on specific areas of the law in order to facilitate referrals and associations. To sign up for the Lawyer-to-Lawyer Directory, complete the form.
June 1: last chance to update Lawyers Desk Book information
Production of the 2008-09 Lawyers Desk Book is underway. All address changes received by June 1 will be reflected in the new edition. The S.C. Supreme Court considers the Bar to be the primary source of attorney information, and address changes made solely with the Court or the Commission on CLE are not reflected in the Bar database. Rule 410(e), SCACR, states that all Bar members are required to promptly notify the Bar of address changes. The Court also requires that all Bar members, except retired members, have a current e-mail address on file with the Bar. Members can send updates to their physical or e-mail address to ljackson@scbar.org or Address Changes, South Carolina Bar, P.O. Box 608, Columbia, SC 29202.

Berkeley High School's mock trial team recently returned from the national mock trial competition held May 7-11 in Wilmington, Del. The students were recognized in the State Legislature on May 14 for placing first among 13 other S.C. high schools that competed in the state mock trial competition in March, advancing them to the national competition. Participating students included Caitlyn Bailey, Kayla Biller, Jessica Bryant, Skyler Carr, Sara Carter, Jessica Hodges, Thomas Horton, Melissa Anne Jackson, Jane Landis, Amanda NeSmith, Ben Pollins, Daniel Prohaska and Cooper West. The lead teacher was Kelli Antes, and attorney coaches were Judge Jack Landis and Elizabeth "Babs" Warner.

The Court of Appeals affirmed the ALC's order granting SGM-Moonglo an off-premises beer and wine permit. Pursuant to Section 61-4-520, the ALC must determine whether a proposed location is proper and suitable prior to granting this type of permit. Restrictions in the chain of title of a proposed location, however, are not a legitimate concern of the ALC in determining whether the location is suitable. Accordingly, the ALC did not err in refusing to consider the existence of a restrictive covenant in the property deed banning the sale of alcohol.

The court affirmed Evans' conviction for possession of a stolen vehicle. Evans argued that certain testimony from a police detective admitted at trial was hearsay and caused prejudice. The court stated that the testimony was cumulative of other eyewitness accounts, insubstantial, and not affecting the result of the trial, and was therefore harmless.

The court affirmed Caldwell's convictions for three counts of violating the eavesdropping or peeping tom statute. Caldwell raised five issues on appeal, and among its holdings, the court stated Caldwell's argument that the statute requires one to look "through windows, doors, or other like places" to be spying was without merit. Section 16-17-470(A) also has a prohibition against "other conduct of a similar nature, that tends to invade the privacy of others." Caldwell's actions toward adolescent males in a restroom, provided "for the kids" at a neighborhood swim meet, fell within the "other conduct" portion of the statute.
