Convention registration closing

Aiken attorney Henderson Johnson to be honored with DuRant Award
The S.C. Bar Foundation Board of Directors is pleased to announce that B. Henderson Johnson Jr. with Johnson Johnson Whittle and Snelgrove will receive the DuRant Distinguished Public Service Award for meritorious service to both the legal profession and his community. The Foundation will confer this honor on Mr. Johnson Friday, January 25, during the plenary luncheon at the Bar Convention. Call for nominations
Nominations are being accepted for odd-numbered circuit and out-of-state representatives to the House of Delegates for two-year terms commencing July 1, 2009. The terms of all current representatives from odd-numbered circuits and out-of-state delegates will expire on June 30, 2008. Any active or senior member in good standing whose principal address is listed in an odd numbered judicial circuit may be nominated as Circuit Delegate by a petition signed by 10 or more active or senior members in good standing residing in the same circuit. Any active or senior member in good standing whose principal office address is out of state may be nominated as an Out-of-State Delegate by a petition signed by ten or more active or senior members in good standing residing within or without the state. The Court of Appeals affirmed the ruling of the Workers’ Compensation Appellate Panel in favor of the employer. While an employee’s fault generally will have no bearing on his right to recover, §42-9-60 makes an exception for the affirmative defense of intoxication. Jones admitted using cocaine during the general time period of his injuries and tested positive for cocaine following the accident, but he denied being under the influence at the actual moment of injury. Although conflicting witness testimony was given, the possibility of drawing two inconsistent conclusions from the evidence does not prevent an administrative agency’s finding from being supported by substantial evidence, and its finding is given deference.
