Calling all host families
Bar member Richard Wagner of Greenville is seeking host families for several exchange student organizations. A host family can be a single adult, single parent, married with children at home or perhaps an empty nester. If you love teens and love welcoming international students, then this opportunity is perfect for you! A host family provides a bed and food and includes the student in the family's regular activities such as church, trips, holidays, etc. If you are interested in being a host family, there are several programs you can browse including the NW Services Peace Program, the FLEX Program and the YES Program. Contact Richard Wagner at (864) 607-5339 if you are interested in this wonderful opportunity to welcome exchange students to South Carolina and America.
Advance Sheet update
April 3, 2008
The Court of Appeals affirmed the Administrative Law Judge's denial of a request by the personal representative for an undue hardship waiver by the decedent's son under the South Carolina Medicaid program. Pursuant to statute, the Department may seek recovery of medical assistance paid by Medicaid from the recipient's estate in certain instances. The Department must waive recovery; however, upon proof of undue hardship asserted by an heir of the decedent. Decedent's son was incarcerated when the estate's personal representative requested the undue hardship waiver. Therefore, the son was not "actually residing" in the mother's home when the hardship waiver application was made, as is required by statute in order to grant the waiver.
Estate of Nicholson v. South Carolina Dep't of Health & Human Servs., No. 4368, is available online.
