Like-kind/1031 exchanges are in as much turmoil as the real estate market itself.  Many Qualified Intermediaries, including the nation’s largest, have gone bankrupt, jeopardizing client exchanges funds.  Indeed, a recent bankruptcy case held that unless a client’s funds were held in a segregated account in a trust relationship those funds are part of the QI’s bankruptcy estate and the client had nothing more than an unsecured claim in bankruptcy.  Still, the deep distress of the real estate market is opening many new opportunities for investors seeking to acquire distressed properties whether in foreclosure or out of bankruptcy.  This program will provide you with a practical guide to 1031/like-kind exchanges in a distressed real estate market, including structuring deals to protect your clients against emerging risks and to take advantage of newly created opportunities.

About the Speaker
Glenn M. Johnson is a Senior Manager in the National Tax Department of Ernst & Young, LLP in Washington , D.C.   He has extensive experience advising clients on like-kind exchange transactions involving real estate, intangibles, and equipment, and multiple asset exchange programs.  He has assisted many companies, including banks, captive finance subsidiaries, and national rental and leasing companies in designing and implementing mass-asset like-kind exchange programs.  Mr. Johnson earned his B.A. in economics from Wesleyan University , his J.D., with honors, from Boston University School of Law, and his LL.M. in taxation from Georgetown University Law Center
