Minutes March 2014

Call to Order, Roll Call and Welcome

Section Chair Mr. Sowell called the meeting to order and welcomed those participating.

Approval of Prior Minutes
The Minutes of the January 23, 2014 (Bar Convention) and February 28, 2014, meetings were adopted by acclamation.

Old Business
Mr. Sowell reported that he would summarize information that Ms. Coker provided concerning the Bar Convention surveys and report to everyone on the distribution list.

Mr. Sowell reported a need to coordinate a seminar with the Young Lawyers Division about working to understand alternative dispute resolution and call it, Young Lawyers Guide to Dispute Resolution. Mr. Sowell would follow-up with Will Johnson concerning the seminar. Mr. Crowe and Judge Kinon would present at the seminar. Judge Kinon would ask Kevin Barnes and Harry Goldberg to assist.

The Council discussed the Ethics Advisory Opinion regarding the ethical duty to pay mediators. Discussion ensued regarding drafting a rule that would go straight through the ADR Commission to the Supreme Court for adoption. Addressed was a concern that filing a rule to show cause in the absence of payment could chill the practice of mediation. Judge Kinon would address the issue with a Supreme Court Justice and would report at the next meeting.

Mr. Crowe reported that Mr. Gallivan received a great response concerning the success rate of ADR from Greenville County. He would contact Ann Kelly, and Mr. Massalon would communicate with the Charleston County Clerk of Court’s office for information on success rates.

Mr. Sowell reported that the Law Student Affiliate Division may not be set up until August. Mr. Sowell requested Mr. Crowe to contact Charmy Medlin at the Bar to inquire about a schedule.

Next Meeting
Mr. Sowell scheduled the next conference call meeting for May 2, 2014, at 9:15 a.m.
