New CLE pub release
A Practical Guide to Elder and Special Needs Law in South Carolina is the enhanced version of S.C. Elder Law: A Practice Manual. With more than 800 pages, 19 sample forms and 10 exhibits, the book has been expanded to include relevant information for attorneys who advise older clients, disabled clients and families of those who are elderly or have special needs. The Lawyer Referral Service is a public service of the Bar offering an inexpensive and practical method of introducing people with legal problems to qualified lawyers. If you have not yet renewed your LRS membership, there is still time to do so before it expires. Current members are asked to renew by June 30. LRS thanks its current membership and reminds all Bar members that they may join at any time.

The S.C. Supreme Court granted a petition for writ of certiorari to review the Court of Appeals’ decision finding Saluda County Council’s practice of amending its agenda during regularly scheduled meetings violated S.C. Code Ann. Sect. 30-4-80 (2007), the notice provision in South Carolina’s Freedom of Information Act (Act). In reversing the decision of the Court of Appeals, the Court held the council did not violate the Act in this instance because the Act’s notice statute does not require an agenda to be issued for a regularly scheduled meeting and because the Act itself contains no prohibition on the amendment of an agenda for a regularly scheduled meeting.

In this dispute concerning an arbitration agreement, the Court found: the appellants did not waive their right to enforce the arbitration clause; the Federal Arbitration Act was applicable; and the respondent failed to carry her burden of showing the AAA was both unavailable and material to the agreement as a whole. Accordingly, the Court reversed the circuit court’s determination that the agreement is unenforceable and remanded for further proceedings consistent with this opinion.

After finding the circuit court improperly granted the State’s Batson motion, the Court reversed the appellant’s convictions and remanded for a new trial.

Member discipline
By order of
June 18 the Court imposed an 18-month suspension (retroactive to August 24, 2011, and with additional conditions) on Kristie Ann McAuley for misconduct which included, while a public defender, representing clients who were not financially qualified to receive a public defender and accepting funds from some of those clients.

By order of June 11 the Court reinstated Jason C. Bybee as a Regular Member.
