Changes to Annotated S.C. Rules of Professional Conduct website
New updates have been added to the Annotated S.C. Rules of Professional Conduct 2013 Edition
website. Updates include supplements through Dec. 31, 2013; Advance Sheets coverage from Feb. 20 through Dec. 31, 2013; Ethics Advisory Opinions 13-02 through 13-09; and ABA Formal Opinions 464 and 465.

If you receive an e-mail with a Google Docs attachment, call the sender and verify the legitimacy of the transmission. A "bomb" virus is circulating via hacked e-mail servers, and the hack has included some S.C. Bar members.

Advance Sheet update

In this appeal from the post-conviction relief (PCR) court, Sullivan alleged his trial counsel was ineffective for not making a sufficient request to the trial court to include language from State v. Burriss, 334 S.C. 256, 513 S.E.2d 104 (1999), in the jury charge on involuntary manslaughter. Because there was no evidence that Sullivan fired the gun unintentionally, the S.C. Court of Appeals determined Sullivan was not entitled to an involuntary manslaughter charge. Thus, Sullivan was not prejudiced by any alleged error of his trial counsel. Accordingly, the court affirmed the ruling of the PCR court.

In this workers’ compensation dispute, the court determined the circuit court erred in reversing the Appellate Panel’s determination that Carter did not suffer a change of condition. The court affirmed the circuit court’s reversal of the Appellate Panel’s modification of the Commissioner’s decision governing Carter’s future medical care and treatment. Given its resolution of the abovementioned issues, the court concluded the employer’s remaining issues on appeal were moot.

Kinard challenged a Master-in-Equity’s order that declined to enjoin the respondents from leasing their property to a third party for the purpose of horse grazing. The court reversed the master’s decision and remanded for entry of an order permanently enjoining the respondents from leasing their property for any purpose other than residential housing.
