Rule 1.19: Succession Planning
The Succession Planning Rule recently adopted by the Supreme Court encourages lawyers to prepare a succession plan and designate a successor attorney. If you have chosen a successor attorney, please submit his/her name(s) to the Bar in the section of your license fee statement titled “Rule 1.19 Succession Planning.” If you do not have successor attorneys, leave the form blank. In addition to your license fee statement, you can also use this form to submit the name(s) of your successor(s). For more information on succession planning, including sample forms, go to the PMAP Winding Down page or e-mail email@example.com.
Certification of Indigent Representation
By order of Dec. 17 the Court approved SCCA Form 236, Certification of Indigent Representation Pursuant to Rule 3(b)(2), SCRCP, for use in S.C. Circuit Courts and Family Courts. The order provides for waiver of filing fees. Read the complete order and find the form online.
Disposition of cases in General Sessions in the 13th Judicial Circuit

Observation status: What does it mean for Medicare recipients?
Did you know: Patients who are in a hospital facility but are designated as "under observation" rather than formally admitted face higher costs while in the hospital and receive no coverage under traditional Medicare for post-hospital rehabilitation in skilled nursing facilities. Read this ABA article to learn more about observation status, why it is used and how you can help clients in this situation.
2013 Bar Foundation annual report: The beat goes on
The 2013 Bar Foundation annual report is now available. Celebrate the grantees and donors that kept the HEART of the Bar going strong by reading the report. Don’t see your name or wish to end 2013 with another gift? For any gift to get to be counted in 2013 (for IRS purposes), it must be in the Foundation office by closing on Dec. 31 or in the mail with a 2013 postmark. Help us help them by downloading our donor form or making a gift online.
Advance Sheet update
December 18, 2013
In this workers' compensation case, the S.C. Supreme Court reversed the Court of Appeals' finding that Shatto was not an employee of McLeod Regional Medical Center and remanded the matter to the Court of Appeals for a determination of whether the petitioner's injuries are compensable. The Court found that evidence preponderated in favor of the petitioner, as McLeod exercised actual direct control over Shatto’s work, provided all the equipment necessary for her to do her job and had the right to terminate her if her work was unsatisfactory.
Shatto v. McLeod Regional Medical Center, Op. No. 27341 (S.C. Sup. Ct. filed December 18, 2013) (Shearouse Adv. Sh. No. 53 at 16), is available online.
Justice Hearn concurred in result only.
