Bar Exam results
The results of the July 2013 Bar Examination will be posted on the S.C. Judicial Department Bar Admissions Page at 4 p.m. on Friday, October 25.
Probate Court Judges Advisory Committee
The S.C. Supreme Court has issued an order designating the composition of the Probate Court Judges Advisory Committee. To view the order and a list of the current committee membership, click here.
Revised Probate Court forms
The S.C. Supreme Court has approved eight new forms for use in Probate Court. Four of the forms are mandatory. Click here to view the order and access the forms.
A conversation with CODA, Sistercare and SCLS
The Bar Foundation asked grantees who work with victims of domestic abuse – Citizens Opposed to Domestic Abuse, Sistercare and S.C. Legal Services – about the critical needs of these women and how they are addressing them through legal services. Read their answers on the
Foundation’s blog. You don’t have to be a legal services attorney to save women who have been traumatized by domestic abuse. Help us help them by downloading the donor form or making a gift online.
Application period open for Rule 608 Civil Contracts
Attorneys interested in contracting with the S.C. Commission on Indigent Defense to provide representation for indigent clients in civil matters (TPR, abuse and neglect, PCR and SVP cases) are invited to submit an application for consideration. This notice only applies to certain designated counties identified on the SCCID website. The link for the application and other important information about the contract program can be found at www.sccid.sc.gov. All applications must be received by 5 p.m. on Nov. 1 to be considered. Questions regarding the application process should be directed to SCCID.

Credit monitoring registration open
Beginning today, Oct. 24, South Carolina taxpayers can register for CSID Identity Protection coverage provded by the state. For more information, visit the CSID website.
UCC best practices survey
Corporation Service Company (CSC) is conducting a survey of UCC Article 9 professionals. South Carolina Bar members who deal with UCC transactions are asked to share their input through this
online survey. For more information about CSC and the survey, please see the press release. The survey closes in December.

The S.C. Supreme Court found the trial judge properly entered judgment in favor of Austin for the entire amount of his requested trial-level fees as this was consistent with the Court’s mandate in Austin v. Stokes-Craven Holding Corp., 387 S.C. 22, 691 S.E.2d 135 (2010). The Court further held that its previous denial of Austin’s request for appellate costs under Rule 222 did not preclude him from seeking appellate and post-appellate fees. Accordingly, the Court affirmed the trial judge’s order and remanded the matter to the circuit court to determine what amount of appellate and post-appellate fees should be awarded to Austin.

The Court denied Martint’s petition for a writ of certiorari to review the S.C. Court of Appeals’ decision as to the issues of laches and waiver. Because determination on the issues of laches and waiver was dispositive, the Court granted Jervey’s petition for a writ of certiorari and vacated the portion of the court of appeals’ opinion addressing the import of S.C. Code Section 42-9-260.

Discipline
By order dated October 23 the S.C. Supreme Court suspended Michael O’Brien Nelson for a period of six months, retroactive to June 1, 2013 (with additional conditions), for misconduct including ex parte contact with a juror during a proceeding. Justice Beatty did not participate.

By order of October 17 the Court placed Cynthia E. Collie on interim suspension. The Court found that, based on her “persistent refusal to comply” with the Court's directives, Ms. Collie poses a substantial threat of serious harm to the public and to the administration of justice.
