Health Care Law Section seminar
The Bar's Health Care Law Section Council will present the seminar, The Patient Protection and Affordable Care Act: It’s Constitutional and It’s Being Implemented ... Are You Ready?, on Friday, May 3, from 8:30 a.m. to 3 p.m. at the Bar Conference Center. The seminar is free for section members, $50 for non-members and qualifies for 5.0 MCLE credit hours. Petition declined
The Court has declined to adopt an amendment proposed by the Bar to define “client file” in the Rules of Professional Conduct.

Fourth Circuit Court of Appeals summaries
Members of the South Carolina Law Review have summarized newly published cases from the Fourth Circuit Court of Appeals. The summaries can be 
found online.

MCLE suspension deadline April 15
To date, there are more than 200 lawyers who have not established compliance with the 2012-2013 MCLE requirements. Pursuant to Rule 419, SCACR, if these lawyers do not earn sufficient accredited CLE hours (or have carry-forward hours from the previous reporting period), file their reports and pay the fees by April 15, 2013, they will be suspended from the practice of law by order of the S.C. Supreme Court. Compliance reports and fees must be received in the Commission’s office by Monday, April 15, to avoid suspension. It is not sufficient if they are mailed by this date. Questions should be directed to the Commission at (803) 799-5578 or 
commcle@bellsouth.net. For those Bar members still needing seminar hours, the S.C. Bar CLE Division is holding video replay seminars on April 10 and April 12.

The S.C. Court of Appeals found the trial court acted within its discretion in admitting the evidence found during the search of the car and in allowing testimony that Tynes could not be excluded as a contributor of DNA found on a gun seized during that search. Additionally, the court affirmed the trial court’s refusal to inform the jury that a witness’s agreement with the State included a condition that he undergo polygraph testing if the State so requested.

The court held the trial court’s findings were inadequate for appellate review and remanded the case to determine whether Bruce had a legitimate expectation of privacy in the trunk of the victim’s car; whether Bruce consented to the search; and, if the police violated Bruce’s Fourth Amendment rights, whether the exclusionary rule applies.

The court found the trial court did not err in admitting Gibb’s testimony or in refusing to charge ABHAN. The court further affirmed the trial court’s decisions on all remaining issues.
