Lawyer-Legislator protection during legislative session
The S.C. Bar appreciates the sacrifices our lawyer-legislators make in order to serve in the General Assembly, which requires time away from their practices and their families. They are to be commended for this important public service. Please be reminded that, pursuant to an administrative order from the S.C. Supreme Court, lawyer-legislators are excused from hearings, trials or depositions scheduled during the legislative session. The Bar appreciates the membership's understanding and support of our lawyer-legislators.

State of the Judiciary address available online
Chief Justice Jean Toal delivered her State of the Judiciary address to the General Assembly on Wednesday. The speech was broadcast live on the Internet and has been archived, along with the PowerPoint presentation, on the Judicial Department website.

S.C. Bar Foundation gives $15,000 to three Upstate grantees
The results of the December Greenville Grantee Gathering allowed the S.C. Bar Foundation to award $15,000, which was divided between three grantees with a presence in Greenville. S.C. YMCA Youth in Government, S.C. Legal Services' Greenville office and Upstate Mediation Center each received $5,000. We’re proud to support organizations that are working to expand access to justice and offer civic education opportunities. Fourth Circuit Court of Appeals summaries

In this appeal of a family court order, the S.C. Supreme Court affirmed in part and reversed in part. On an issue of first impression in South Carolina, the Court held that while a trust corpus is not the property of either spouse and thus cannot be marital property, trust distributions can be marital property depending on how and when the interest was acquired or if the interest has undergone transmutation. The Court further affirmed the classification of the trust distributions, two Palmetto Bank accounts, a Smith Barney account and the husband’s federal annuity payments as marital property; the classification of the wife’s accounts as nonmarital property; and the ratio used to divide the marital estate. The Court concluded the family court erred in finding that timber land inherited by the husband had become marital property through transmutation; in failing to give the husband credit for the increase in equity in the marital home; and in reserving jurisdiction on the issue of alimony. The Court also reduced the award of attorney’s fees and costs.
