The Board of Governors met on February 15. The Board received an update on issues before the General Assembly and a proposal before Lawyers Helping Lawyers to create support networks. Shaheena Bennett was approved to begin serving as an At Large Board member in May. The International Law Committee was moved from virtual to active status. A policy prohibiting the President and President-Elect from supporting judicial candidates, except in limited circumstances, was adopted.

Did you know?
One hundred and ninety-two S.C. attorneys assisted with the Bar's 2012 Middle School Mock Trial program. As a result of those efforts, 822 students participated and learned about our court system. Compliance reporting deadline next week
All active attorneys licensed before March 1, 2012, must file their 2012-2013 compliance reports with the Supreme Court Commission on CLE and Specialization by Friday, March 1. Currently, more than 70 percent of Bar members have not yet filed their reports and established compliance with the mandatory CLE requirements. Compliance reports showing sufficient credit hours, along with the filing fee, can be mailed to the Commission at P.O. Box 2138, Columbia, SC 29202 or hand-delivered (or overnighted) to the Commission’s office located at 950 Taylor St., Ste. 120, Columbia, SC 29201. Reports postmarked after March 1 must include a late fee. Questions should be directed to the Commission at (803) 799-5578 or firstname.lastname@example.org.
Compleat Lawyer honorees announced
The USC School of Law has announced its 2013 Compleat Lawyer Award recipients: Platinum (30 or more years in profession): William W. Doar Jr., Steven M. Hamm and Kathleen C. McKinney; Gold (15-29 years in profession): Cherie W. Blackburn, Cynthia Durham Blair and Sherri A. Lydon; Silver (14 years or less in profession): Thomas P. Gressette Jr., Amy L.B. Hill and Maj. Scott W. Medlyn. The awards dinner will be held Thursday, April 25, in Columbia.

Kirby Mitchell named Ellen Hines Smith Legal Services Lawyer of the Year
Congratulations to Kirby Mitchell for being named the Ellen Hines Smith Legal Services Lawyer of the Year! The award, in memory of Ellen Hines Smith of Spartanburg, recognizes a lawyer who has demonstrated commitment to the development and delivery of quality legal services to the poor in South Carolina. In this workers’ compensation case arising out of an automobile accident, the S.C. Court of Appeals affirmed the decision of the S.C. Workers’ Compensation Commission’s Appellate Panel (Panel) on all issues. The Panel did not err in not granting Brown lifetime medical care for his lower back problems, not raising the compensation rate and not writing its own order. Further, the Court of Appeals did not err in denying Brown’s motion for leave to present additional evidence to the Workers’ Compensation Commission pursuant to Section 1-23-380(3) of the S.C. Code.

The court affirmed the trial court’s refusal to reform Cohen’s motorcycle insurance policy to include underinsured motorist (UIM) coverage. In affirming the trial court’s finding that Progressive had made a meaningful offer of UIM coverage, the court held that an insurer’s noncompliance with Subsection 38-77-350(B) of the S.C. Code does not mean the insurer did not make a meaningful offer in compliance with Section 38-77-160. Rather, it means a trial court must then make the factual determination of whether a meaningful offer was made.
