Middle School Mock Trial state competition results
Forestbrook Middle School won the S.C. Bar Middle School Mock Trial State Competition on Saturday, Dec. 8, marking the school's third state title. Ocean Bay Middle School was named runner-up. Participating students included Holley Black, Calie Glasgow, Ashlyn Herring, Erica Holt, Kasie Ingram, Ashley Jones, Joey Kirkman, Jaida Lankford, Nayah Lewis, Aly Loyd, DeAnna Mason, Ashley Murray, Katelyn Price, Georgette Riviera, Sydny Stegall, Sophie Stevanovich, Lauren Stevens and Cinthia Zavala. The teacher coaches were Lisa Aglietti, Joe Boswell, Stephanie Necessary, April Scott and Joey Trail. The attorney coaches were Scott Hucks and Gene Vaught. The S.C. Bar thanks the attorney volunteers as well as the staff at the Marc H. Westbrook Lexington County Judicial Center, Lexington County Summary Court, Lexington Sheriff's Department and Lexington Police Department, whose contributions helped make this competition a success.
Application period open for Rule 608 civil case contracts
Attorneys interested in contracting with the S.C. Commission on Indigent Defense to provide representation for indigent clients in civil matters (post conviction relief and sexually violent predator actions included) are invited to submit applications for consideration. This notice is for contracts in the 20 counties not previously noticed in September. The link for the application and other documents concerning the civil case contract program is located on the home page of the SCCID website. Please note some changes have been made to the contract language concerning the amount of malpractice coverage required. All applications must be completed and received by SCCID no later than 5 p.m. on Dec. 26. Questions regarding the application process should be directed to the commission at (803) 734-1343.
Amendments to Rule 410 of the S.C. Appellate Court Rules
On May 7, 2012, the S.C. Supreme Court issued an order revising Rule 410, SCACR. The revised Rule 410 is effective Jan. 1, 2013, and will govern the license fees for lawyers and foreign legal consultants that are due on January 1, 2013. View the complete order online.

In this appeal from family court, the S.C. Court of Appeals affirmed the family court's decision to award the wife a portion of her husband's military retirement benefits but increased the wife's share based on her contributions to the parties' marriage. The court further remanded the issue of child support to the family court for reconsideration based on the husband's diminished income and affirmed the family court's decision to require the wife to pay the outstanding debt on a vehicle acquired by the parties during the marriage.

This case is an appeal of the circuit court's order affirming the decision of the Appellate Panel of the Workers' Compensation Commission. The court reversed as to the June 2007 injury to Burnette's lower back, finding that the circuit court erred in affirming findings of fact that were unsupported by substantial evidence in the record. The court remanded to the commission with a specific instruction that the commission reconsider this issue and enter findings of fact concerning Burnette's lumbar injury that are supported by substantial evidence in the record. The court declined to address the issue of credibility.
