Advance Sheet update
September 26, 2012
In this post-conviction relief (PCR) action, the S.C. Supreme Court reversed and remanded the decision of the PCR court. The petitioner alleged that his attorney had waived his right to a jury trial without the petitioner’s consent. A right to a trial by jury is validly waived when there is a complete record showing that the petitioner knowingly and voluntarily waived that right. The Court, opining that no such record existed in this case, held that the PCR court erred in its ruling that the petitioner had received effective counsel.
