Board of Governors meets
The Board of Governors met Feb. 24 and approved:
• a request from the Family Law Section to support H.4614 regarding joint custody, with amendments;
• a request from the Family Law Section to support H.4738 regarding award of alimony, with amendments;
• a request from the Family Law Section to support S.299 regarding a statement alleging abuse or neglect made by a child to a forensic interviewer;
• a request from the Probate, Estate Planning and Trust Section to oppose as drafted S.234 regarding the transfer of interest in real property; and
• a proposed survey from the Member Involvement Task Force.

Public hearings scheduled for judicial candidates
The Judicial Merit Selection Commission has scheduled public hearings beginning Tuesday, April 17, at 9 a.m. for the candidates for judicial positions listed on this
media release. Persons desiring to testify at public hearings should furnish written notarized statements of proposed testimony by noon on Monday, April 2, to the Judicial Merit Selection Commission, Jane O. Shuler, 104 Gressette Bldg., P.O. Box 142, Columbia 29202. 

Attorneys chosen to head DHEC and LLR
Catherine Templeton has been named by Gov. Nikki Haley as Commissioner of the S.C. Department of Health and Environmental Control. Templeton was confirmed by the S.C. Senate on Feb. 28, 2012.
Gov. Haley also chose Holly Gillespie Pisarik to head the Department of Labor, Licensing and Regulation. Pisarik will serve as interim director pending confirmation by the Senate.

Advance Sheet update
February 29, 2012
The S.C. Court of Appeals affirmed the ruling that the respondent was not liable on the plaintiff’s materialman’s lien when the respondent had paid its contractor in full after receiving the plaintiff’s notice. The court determined that S.C. law does not protect a materialman’s lien until after the materialman records and serves a statement of the lien. Since the plaintiff’s notice of the lien was ineffective pursuant to S.C. Code Section 29-5-40, the respondent was not liable for it. The court also affirmed the award of the respondent’s attorney’s fees.

In this dispute between two realtors, the court affirmed the circuit court’s denial of the appellant’s directed verdict motion because there was conflicting evidence as to whether a contract was formed. The court also affirmed the respondent’s directed verdict motion on an Unfair Trade Practices Act violation because there was no evidence that the respondent’s actions caused public harm. Finally, the court determined that it was error for the circuit court to sua sponte charge the jury on conversion because this charge was not anticipated at trial. The court, therefore, reversed and remanded this issue.
