High School Mock Trial Regional Competition results
The 2012 High School Mock Trial Regional Competitions were held on Saturday, Feb. 25. Congratulations to Bob Jones Academy (Greenville), Chapin High School, Fort Dorchester High School (N. Charleston), Greenwood High School, Lexington High School, the Montessori School of Anderson, N. Myrtle Beach High School, Socastee High School (Myrtle Beach), Spring Valley High School (Columbia), Strom Thurmond High School (Johnston), Wando High School (Mt. Pleasant) and Wilson High School (Florence). Students will compete in the State Competition March 9-10 at the Matthew J. Perry Jr. Federal Courthouse in Columbia. The Law Related Education (LRE) Division thanks all of the attorney volunteers that made the 2012 High School Mock Trial Regional Competitions a success. Attorney volunteers served in the roles of mock trial regional coordinators, attorney coaches, scoring judges and presiding judges. Member Involvement Task Force survey
The Bar’s Member Involvement Task Force is studying ways to increase member involvement in Bar activities. The task force is asking Bar members to complete a brief, eight-question survey regarding incentives and barriers to participation in Bar work. Click

Client file destruction rule adopted
By order of March 1 the Court has amended Rule 1.15, RPC, Rule 407, SCACR, to create the timetable and terms under which a client file may be destroyed. The order can be found here.

In this case arising from an unsuccessful merger leading to bankruptcy, the S.C. Supreme Court affirmed the defendant’s conviction of securities fraud with a five-year sentence and acquittal of making a false statement and conspiracy. The Court rejected the defendant’s assertion that it was error to allow investors to testify because the issue was not preserved for review. The Court also held that the trial court was correct in denying the defendant’s directed verdict motion and that the defendant did not preserve that motion for appeal. Finally, the Court concluded that there was no reversible error in the jury charge because there was abundant evidence that the defendant intentionally engaged in fraud.

Justice Hearn concurred in part and dissented in part in a separate opinion.

Member discipline
By order of February 29 the Court imposed a public reprimand on Glenn Oliver Gray for misconduct which included lack of diligence in completing a client’s matter and practicing law while suspended from practice.

By order of February 29 the Court disbarred William R. Taylor (and ordered him to pay restitution) for misconduct which included failing to safeguard funds belonging to a bank in connection with real estate transactions, misappropriation of client funds, a guilty plea to breach of trust with fraudulent intent and incurring debt in his wife’s name without her knowledge and consent.

By order of February 23 the Court reinstated Craig J. Poff to the practice of law.
