Advance Sheet update
January 4, 2012
In this workers' compensation action, the S.C. Court of Appeals affirmed the circuit court’s ruling. The court found that, viewed appropriately in light of Ellison II, there was substantial evidence in the record to support the Appellate Panel's decision that the appellant did not have a greater disability as a result of the combined effects of his previous injuries and his current injury. Therefore, the court did not reach the remaining issues relating to loss of earning capacity.
Dinkins v. Lowe’s Home Centers, Inc., No. 4926, is available
online.

The court reinstated the respondent’s conviction and reversed the circuit court order reversing the respondent’s conviction of driving under the influence (DUI) on the basis of an alleged insufficiency in the number of potential jurors from which to draw a jury for Johnson's trial in magistrate court. The court found that, in construing S.C. Code Sections 22-2-80 and 90, the presence of 33 jurors in this case was sufficient to select a qualified jury panel from the jury pool. The circuit court effectively read that Section 22-2-90 required that a minimum of 40 individuals appear and be available for jury selection, while the plain terms of the statute require only that 40 individual names be drawn and ordered to appear. The legislature has set forth no specified number of jurors required to be present and available in the jury pool before jury selection can proceed.
State v. Johnson, No. 4927, is available
online.
