Bar offices closed

Court approves FAQs

February 2012 Bar exam laptop usage
The Board of Law Examiners will allow a limited number of applicants to use laptops to complete their answers to the essay sections of the February 2012 Bar Examination. One hundred and sixty applicants will be randomly selected from those applicants whose completed 
Request to Participate forms are received no later than Friday, Dec. 16.

The appellant appealed a ruling by the Appellate Panel of the S.C. Workers' Compensation Commission denying the appellant’s claim for repetitive trauma injuries to his shoulders. The appellant challenged the Commission's interpretation and application of S.C. Code Ann. Section 42-1-172 (Supp. 2010). The Court reversed and remanded on the grounds that the Commission erred in admitting a medical opinion that was not stated to a reasonable degree of medical certainty as required under Section 42-1-172.

In this land management case, the Court reversed and remanded an administrative order permitting construction of erosion control devices on a narrow peninsula near Seabrook Island on the basis of several errors of law.
Kiawah Development v. SCDHEC, No. 27065, is available

Chief Justice Toal dissented in a separate opinion.

The Court previously granted a writ of certiorari to review the Court of Appeals' decision to order a new trial after the trial judge refused to charge the jury on the law of self-defense. The Court dismissed the writ as improvidently granted.

By order of November 16 the Court reinstated Rose Marie Cooper.

By order of November 17 the Court placed Wilton Darnell Newton on interim suspension. Adam R. Artigliere is the trustee. 

By order of November 21 the Court imposed a two year suspension (retroactive to September 27, 2005, and with additional conditions) 
on James H. Dickey for misconduct which included creating a document which appeared to be a medical record, willfully failing to comply with a final decision of the Resolution of Fee Disputes Board and failing to prosecute a client’s case.

By order of November 21 the Court disbarred Ivan N. Walters based upon his disbarment by the North Carolina State Bar.
