Important notice about your information in the Lawyers Desk Book
Production of the 2014-15 Lawyers Desk Book is underway, and address changes must be made by June 1 to be reflected in the new edition. All changes in contact information are handled by the S.C. Attorney Information System (AIS) exclusively, and you must log on to AIS to update your information; for assistance, call 1-855-235-2500. Complete contact information will be published for all Bar members, to include name, organization, mailing address, phone number and e-mail address.
If you have not entered your fax number in AIS, the Bar does not have it on file. While AIS does not require fax numbers, you must enter one if you would like it to appear in the Lawyers Desk Book. To ensure your zip code matches the address published, please do not enter two addresses (P.O. Box and Street) in a single address field. Please review your information carefully, as it will be published as entered in AIS.
House of Delegates elections
The following have been elected to vacancies in the House of Delegates with terms beginning July 1, 2014: Mandy Shuler, Third Judicial Circuit; Stinson Ferguson and Perry Gravely, 13th Judicial Circuit. Congratulations!
PMAP Tech Tip
Lawyers are often required to research and understand more than just the law when working on a case. Google is one of the best non-legal research tools out there, especially if you know a few tricks to make your search more efficient. For example, did you know you can narrow your search results by currency? If you want to see only recent entries about a specific news event or product, Google lets you search by the past hour or year, or within a custom date range. You’ll see these options when you click “search tools.” For more time-saving search tricks, read 11 Google Search Tips Everyone Should Know. You may also want to check out the book Google for Lawyers: Essential Search Tips and Productivity Tools from the Bar’s Lending Library.
Lawyers 4 Vets needs you
The S.C. Appleseed Legal Justice Center is partnering with the Veteran Justice Outreach Program at the Dorn VA Medical Center and members of the S.C. Bar to establish a Pro Bono Veterans Legal Clinic. This clinic will connect lower-income veterans with local attorneys who will provide one-on-one pro bono legal advice and/or representation. To learn more about volunteering, view the brochure or contact Ashley Thomas at firstname.lastname@example.org.
Enjoy the speeches at Gala 2014? Let the Foundation speak for your next event!
Guests at the eighth annual Foundation gala heard from colleagues and Gov. Riley talk about the importance of Foundation support and what those funds do for the people of South Carolina. If you are looking for a speaker for your event or are interested in gathering with some colleagues to learn more about your Bar’s Foundation, contact Executive Director Shannon Willis Scruggs.
Advance Sheet update
April 2, 2014
The S.C. Court of Appeals affirmed Gore’s conviction for trafficking cocaine, finding the circuit court did not err in failing to charge the jury on the lesser-included offense of simple possession or in denying Gore’s motion to challenge the veracity of the search warrant affidavit pursuant to Franks v. Delaware, 438 U.S. 154 (1978). While the court did find the circuit court erred in admitting two photographs into evidence, the court ultimately found the error harmless.
State v. Gore, Op. No. 5214 (S.C. Ct. App. filed April 2, 2014) (Shearouse Adv. Sh. No. 13 at 53), is available online.
The Court of Appeals found the family court did not err in finding the wife’s inheritance was transmuted into marital property or in relying on the GAL’s investigation and report in making its custody determination. The court found the remaining issue of whether the family court deprived the wife of her due process rights by considering the GAL’s report when the GAL failed to timely submit his report as required by S.C. Code Section 63-3-830(A)(6) was not preserved for review.
Adams v. Adams, Op. No. 5215 (S.C. Ct. App. filed April 2, 2014) (Shearouse Adv. Sh. No. 13 at 64), is available online.
The Court has accepted the resignation from the Bar of William Thomas Newell as he no longer meets the requirements of Rule 405, SCACR.
Former Bar member Norman E. Fogle, 79, of Neeses died April 6. His obituary can be found here.
