Advance Sheet update
January 2, 2014
By order of Jan. 2 the S.C. Court of Appeals upheld the circuit court's decision to deny the appellant's motion to amend his complaint based on prejudice to the respondent. The court also found the circuit court properly granted summary judgment on the appellant's claims for design defect and failure to warn.
Holland v. Morbark, Inc., No. 5186, is available online.

In an order dated Jan. 2 the court found the circuit court did not err in submitting the claim of attempted first degree burglary to the jury after it granted a directed verdict in appellant Green’s favor on the charge of first degree burglary. The court found the trial court was correct in ruling that attempted first degree burglary is a lesser-included offense of first degree burglary and that the appellant was on notice of the charge and its lesser included offenses.
State v. Green, No. 5187, is available online.
