Advance Sheet update
August 21, 2013

Isaac appealed the trial judge’s denial of his request for a hearing to determine whether he was immune from prosecution under the Protection of Persons and Property Act (the Act). After expediting the matter, the S.C. Supreme Court dismissed the appeal and remanded for trial because the General Assembly did not intend for the Act to apply to a shooting that occurred prior to the Act’s effective date and because the denial of a defendant’s request for immunity under the Act is an interlocutory order not subject to immediate appeal.
State v. Isaac, Op. No. 27302 (S.C. Sup. Ct. filed August 21, 2013) (Shearouse Adv. Sh. No. 37 at 15), is available
Justice Pleicones concurred in a separate opinion.

In this products liability appeal, the S.C. Court of Appeals affirmed the trial court’s decision to charge the jury on the sophisticated user doctrine. The court reversed the trial court’s decision to grant summary judgment on Lawing’s strict liability cause of action, finding the trial court employed too restrictive a definition of the term “user” under S.C. Code Section 15-73-10. The court determined the legislature intended for the term “user” to include persons who could foreseeably come into contact with the dangerous nature of a product. Accordingly, the court remanded the matter to the circuit court for a new trial on that cause of action.
Lawing v. Trinity Manufacturing, Inc., Op. No. 5166 (S.C. Ct. App. filed August 21, 2013) (Shearouse Adv. Sh. No. 37 at 26), is available
