Judge Anderson selected for 2013 American Inns of Court Professionalism Award
The Hon. Joseph F. Anderson Jr., U.S. District Court for the District of South Carolina, has been selected to receive the 2013 American Inns of Court Professionalism Award for the Fourth Circuit. The award will be presented June 28 at the Fourth Circuit Judicial Conference in West Virginia.

By order of May 20, the Court amended Appellate Court Rule 419, Administrative Suspensions. For persons whose memberships were administratively terminated under Rule 419 prior to this order, their membership records shall be changed to reflect that they are now administratively suspended. They may seek reinstatement as provided by paragraph (e) of the revised rule.

The S.C. Court of Appeals affirmed the circuit court’s order granting Proctor’s motion for summary judgment. The court held that with respect to gambling losses under the circumstances of the instant case, the doctrine of in pari delicto has been abrogated for reasons of public policy and does not bar recovery of such losses.

In this criminal appeal, the court reversed, finding no evidence to support the charge of aiding and abetting against Lewis. Because the court determined a directed verdict should have been granted in Lewis’ favor, the court did not address Lewis’ remaining arguments.

Chief Judge Few concurred in a separate opinion.
In this quantum meruit cause of action, the court affirmed the decision of the circuit court. The court determined that although there was no meeting of the minds, the circuit court did not err in holding that Boykin Contracting, Inc. (BCI) could recover from Kirby on a quantum meruit theory since BCI was still entitled to recover the reasonable value of its labor and materials. The court affirmed the damages award, finding it fair, reasonable and within the circuit court’s discretion. The court also affirmed the award of prejudgment interest because the amount owed to BCI was “capable of being reduced to a sum certain” and the measure of recovery was fixed by conditions existing at the time BCI’s claim arose against Kirby.
