Preserving history with the Bar Foundation Oral History Program
Despite the best searches of past Bar publications, newspapers and other records, the Bar Foundation quickly discovered that the events and personalities surrounding some significant occurrences remained half hidden, like icebergs. To preserve history, the Bar Foundation began interviewing the legal legacies that were part of those events, immortalizing their work and experiences for today’s legal community. Visit the Bar Foundation’s website to learn about the men and women who left a lasting impression on the legal profession. Transcripts of the interviews can be found at the South Caroliniana Library under the S.C. Bar Foundation Oral History Collection.
Advance Sheet update
May 2, 2013
The mother appealed the family court's termination of her parental rights to her minor child. The S.C. Court of Appeals reversed and remanded this case for a permanency planning hearing pursuant to Section 63-7-1700 of the S.C. Code, holding that the family court erred in finding TPR was in the child’s best interest. The court found there was undisputed evidence of the child's bond with the mother, that the evidence suggested he was not a viable candidate for adoption, and that DSS had not identified a pre-adoptive home for the child. The court noted its cognizance of policy considerations that seek to prevent a child from languishing in foster care and distinguished this matter due to the child's strong bond with the mother and DSS's failure to identify a pre-adoptive home. The court made no finding as to whether reunification with the mother is in the child's best interest. The family court was urged to conduct a hearing as expeditiously as possible, including presentation of a new GAL report and an updated home evaluation of the mother's residence, allowing for the possibility of the family court to, inter alia, change custody, modify visitation and approve a treatment plan offering additional services to the mother.
