Advance Sheet update
January 2, 2013
In this appeal, the S.C. Court of Appeals reversed Frazier's convictions for murder and possession of a firearm during the commission of a violent crime. The court affirmed the trial court's denial of Frazier's request for a voluntary manslaughter charge. However, because the court found sufficient evidence in the record from which a jury could infer Frazier acted in self-defense, the court found the trial court erred in permitting an inference of malice based upon Frazier's use of a firearm and declining to charge self-defense.
State v. Frazier, No. 5069, is available online.
In this insurance dispute, the court reversed the trial court's grant of summary judgment and held that South Carolina's Motor Vehicle Financial Responsibility Act does not allow recovery of minimum limits liability coverage on a motor vehicle liability insurance policy when a person named in a policy provision pursuant to Section 38-77-340 of the S.C. Code is operating the motor vehicle.
