Richland County to introduce back-up, non-jury trial roster
Beginning on Monday, May 7, the Richland County Clerk of Court will begin to schedule a back-up, non-jury trial roster to the jury trial roster. Non-jury trials will be held if the jury trial roster fails to provide a case for trial. As many cases settle or are otherwise unavailable to go to trial, this back-up docket will effectively make use of court resources and expedite outstanding matters. Additionally, on a trial basis, beginning in June 2012, motions will not be scheduled on Fridays for non-jury motion terms, so as to provide a day to hear motions more quickly than through the normal scheduling process. To schedule, contact Paul Gunter at or (803) 576-1932.

Advance sheet update
March 21, 2012
In this appeal of a conviction for drug trafficking, the S.C. Court of Appeals followed the precedent case of State v. Ballenger and held that the trial court erred in presenting a jury charge of constructive possession. There was no factual basis for the charge as the defendant had no dominion or control over the drugs, which were found in a public place. The charge was prejudicial since it had the potential to confuse the jury and to affect the outcome of the case. Therefore, the conviction was reversed, and the matter remanded for a new trial.
