Judicial election results

In this appeal from a conviction and sentence for second-degree arson, the Court of Appeals affirmed the circuit court's refusal to direct a verdict because Appellant's argument that the abandonment of the mobile home prior to the fire changed its status from a dwelling was meritless. The court reversed the sentence of life without the possibility of parole and remanded for resentencing because it opined that the State failed to establish that Appellant's 1979 conviction was for a serious offense.

The court affirmed the circuit court's affirmance of the magistrate's order finding a Speedmaster machine confiscated from a convenience store was not an illegal gaming device pursuant to Section 12-21-2710 of the S.C. Code because it constituted a game of skill as opposed to a game of chance and it was not used for gambling under the statute. Issues not preserved for review were whether any machine with a free play feature should be automatically deemed illegal and whether SLED was entitled to a new post-seizure hearing because the tapes of the original proceeding were lost.
