Mark your calendars for Community Law Week the first week in May!
Law Week is designed to promote the legal profession and provide the public with information about their legal rights. A number of circuits will participate in Cocky's Reading Express program by USC. Lawyers will travel with Cocky, visiting elementary schools across the state to read to the children.

Constitution and bylaw amendments proposed
Constitution and bylaw amendments will be considered by the House of Delegates and Assembly at the meetings of both entities on May 5. The proposed amendments would alter the composition of the Board of Governors by eliminating the third year of an at large member and comport bylaws to Appellate Court Rules regarding Rule 415, SCACR. County added to mandatory ADR list
By order of April 7 Oconee County Family Court has been designated for mandatory ADR. This order becomes effective on June 1. To view the full text of the order, click here.

Law School candidate withdraws name from consideration
USC Law School Dean candidate Dr. Stephen Mazza withdrew from consideration on April 1. He accepted the position of Dean at the University of Kansas School of Law.

The S.C. Supreme Court reversed the decision of the Court of Appeals, finding that the decision of the Workers' Compensation Commission was affected by an error of law and that remand was necessary to permit the Commission to make additional findings of fact after applying the law set forth in Ellison v. Frigidaire Home Products, 638 S.E.2d 664 (S.C. 2006). In Ellison the Court held that aggravation was not a requirement but an alternative analysis. Justice Pleicones concurred in the result only.

The Court had issued a writ of certiorari so it could review Bostick's direct appeal issues. The Court analyzed three seminal cases which themselves analyze the proof necessary in cases with circumstantial evidence. The Court held that the evidence in the immediate case raised only a suspicion of guilt and reversed the circuit court because the directed verdict motion should have been granted.

Opinion substituted
By order of April 11 the Court issued a substitute opinion in the Matter of J. Cameron Halford.

By order of April 7 the Court reinstated Joseph W. Ginn III to the practice of law subject to conditions set forth in the order.
By order of April 8 the Court reinstated Michael Jarrett Allan to Inactive Member status.

Reinstatement sought
Charles E. Johnson has petitioned for reinstatement. The Committee on Character and Fitness invites persons to appear on May 12 at 9:30 a.m. in support of or opposition to the petition.
By order of April 7 the Court accepted the resignation from the Bar of Thomas N. Steenburg.
