MCLE reporting deadline is March 31
The Supreme Court Commission on CLE and Specialization sent final notices this week to more than 600 attorneys who have not yet established compliance with the 2010-2011 MCLE/LEPR requirements. Non-compliance may result from failure to file your compliance report, failure to report sufficient accredited course hours, failure to pay fees or other reasons. If the Commission does not receive your compliance report and fees by Thursday, March 31, 2011, you will be automatically suspended from the practice of law without further notice. Compliance reports must reflect that you have earned sufficient accredited CLE course hours or had sufficient carry-forward hours from the previous reporting period, and they must be accompanied with the appropriate fees. Questions should be directed to the Commission at (803) 799-5578 or
Gala results are in...
The Bar Foundation's March 3 gala celebration held in honor of the Nifty Fifty Class of 1960 included a special recognition of three Foundation donors: Walt McLeod, Eddie Weinberg and John P. "Jack" Wilson, as well as the Ellen Hines Smith Legal Services Lawyer of the Year, Susan Firimonte, and the Pro Bono Award winners, Christopher Genovese and Alex Paterra. Approximately 300 guests enjoyed a seated dinner, dancing and a silent auction with a wide array of items from hotel stays to art. The auction alone generated a net profit exceeding $5,000. Final calculations are still in progress, but it is estimated that gala proceeds will be in excess of $26,000! If you would like to make a gift honoring any of our award winners or would like to be a part of the celebration, send your gift to the Foundation or contact us to make your gift via credit card. Photos of the evening may be viewed at the RIM Photography website. Thank you to our gala sponsors!  Your Bar Foundation is the only statewide entity that funds the advancement of justice by improving access, education and accountability. Gala 2011 is just one effort to augment the Foundation’s mission. Please join us.

Advance Sheet update
March 16, 2011

The Court of Appeals affirmed the family court's denial of Husband's request to terminate alimony based on Wife's continued cohabitation. The court also affirmed the family court's award of attorney's fees to Wife because the family court's order demonstrates it considered the Glasscock factors and rendered a decision based on an unchallenged attorney's fees affidavit.
Biggins v. Burdette, No. 4808, is available online.

In this divorce action, the court: (1) reversed the family court's finding that the that the rental properties were transmuted into marital property and subject to equitable distribution; (2) found that the family court properly determined the Southern Union Revolving Fund account was marital property to be equitably divided; and (3) affirmed the family court's decision to include 31 percent of the relocation benefit in the marital estate, as the issue was not raised at trial and therefore not preserved for review.
Smallwood v. Smallwood, No. 4809, is available online.
