Advance Sheet update
February 15, 2011
Maurice and Marquise Stinney were expelled from Sumter High School for fighting. The boys' parents appealed to the Board of Trustees (Board), who affirmed the expulsion. The Stinneys then filed suit in circuit court claiming a due process violation. The circuit court granted the Board's motion for summary judgment because the Stinneys did not exhaust their administrative remedies, and the Court of Appeals reversed. The S.C. Supreme Court held it was a legal error to apply the doctrine of exhaustion of administrative remedies in this case because the Stinneys were not appealing the expulsion but rather the new lawsuit regarding due process. Since the Court may affirm for any reason appearing in the record, the Court affirmed the circuit court's grant of summary judgment for the Board because the Stinneys were provided due process.
Stinney v. Sumter School District, No. 26928, is available online.
The Court affirmed the circuit court's holding that the Appellant was not entitled to interest under S.C. Code Section 34-31-20 because the Appellant had not met the requirements of Section 29-6-50 and Section 34-31-20(A) only applied in the absence of a contractually agreed upon interest provision.
EllisDon Construction v. Clemson University, No. 26929, is available online.
Justice Pleicones concurred in a separate opinion.
