Board of Governors meets
The Board met October 10 via conference call.

The Board approved a request from the North Carolina State Bar to join in an amicus curiae brief if certiorari is accepted by the U.S. Supreme Court in a case involving a professional licensing board.

Recommendations for the adoption of a discount travel program and discount insurance program were approved.

ADR certification renewals
ADR renewal applications were mailed Oct. 9, 2013. If you have recently changed your address in the Attorney Information System and have not received your renewal application, please contact Joan Brown at (803) 799-6653, ext. 138 or jbrown@scbar.org. Applications must be postmarked by Dec. 31, 2013, to avoid incurring late penalties.

PMAP Tech Tip
If you draft documents in Microsoft Word, you probably rely on the copy and paste function to some extent. Most of us have experienced the frustration of inserting copied text and seeing it pasted in the wrong font or size for your document. Sure, you can use “paste special” every time, but there is a lasting solution that will save you time. Attorney at Work has posted
easy instructions on how to set Word’s Paste options. Once you’ve changed your default settings, Word will remember your preferences the next time you need to copy and paste. Contact PMAP for free assistance with your law practice at pmap@scbar.org.

Application period open for Rule 608 Civil Contracts
Attorneys interested in contracting with the S.C. Commission on Indigent Defense to provide representation for indigent clients in civil matters (TPR, abuse and neglect, PCR and SVP cases) are invited to submit an application for consideration. This notice only applies to certain designated counties identified on the SCCID website. The link for the application and other important information about the contract program can be found at www.sccid.sc.gov. All applications must be received by 5 p.m. on Nov. 1 to be considered. Questions regarding the application process should be directed to SCCID.

Warning: Fake IOLTA notice
On Monday, Oct. 8, an e-mail addressed to a @scbar.org address alleged the recipient’s IOLTA account had insufficient funds to pay an outstanding check. The e-mail included a .zip file attachment purportedly containing additional information and presumably contained malware. Other state bar foundation/IOLTA programs have reported similar e-mail messages.

October 9, 2013
The S.C. Court of Appeals reversed Lane’s conviction for first-degree burglary. The court held the trial court erred by refusing to grant a directed verdict, as the State failed to present substantial circumstantial evidence that Lane was guilty of first-degree burglary. The court opined that at most, the evidence presented raised only a mere suspicion he committed the crime.

In this workers’ compensation dispute, the court affirmed the Appellate Panel’s determination of jurisdiction, finding the preponderance of the evidence demonstrated Palmetto Collision, LLC employed four employees at the time of the accident. The court, however, found substantial evidence in the record did not support the Appellate Panel’s determination that the claimant provided Palmetto Collision, LLC with timely notice of his injury. Consequently, the court reversed the award of benefits to the claimant. Because the issue of notice was dispositive of this appeal, the court did not reach the employer’s remaining issues.
