Help make Cinderella dreams come true
The 2013 YLD Cinderella Project is underway! The annual project provides gently worn formal, bridesmaid and prom dresses, evening bags, jewelry, shoes and other accessories to young women who lack the financial resources to buy these items for their high school prom. Donation sites in Aiken, Anderson, Columbia, Greenville, Greenwood and Orangeburg are 
posted online.

The S.C. Supreme Court found the post-conviction relief (PCR) judge erred in summarily dismissing McCoy’s second PCR application because genuine issues of material fact exist as to whether his claim is successive or time-barred. The Court reversed the dismissal of McCoy’s application and remanded the matter for an evidentiary hearing. Further, for the benefit of the bench and the bar, the Court clarified the proper legal standard for claims involving juror misconduct. In the context of PCR, juror concealment claims are governed by the analysis set forth in State v. Woods, 345 S.C. 583, 550 S.E.2d 282 (2001), not the five-pronged newly discovered evidence test set forth in Clark v. State, 315 S.C. 385, 434 S.E.2d 266 (1993).

In this direct appeal from the administrative law court, the Court affirmed and held that, irrespective of Hampton Friends’ status as a nonprofit eleemosynary corporation, the property is subject to 2008 property taxes because the property was subject to property taxes as of Dec. 31, 2007.

The Court had granted the state’s writ of certiorari to review the grant of Marshall’s application for post-conviction relief. It dismissed the writ as improvidently granted.
