Advance Sheet update
October 3, 2012
The S.C. Court of Appeals reversed the circuit court, finding it erred in denying the motion to compel Pearson to comply with the arbitration clause in the contract between Hilton Head Hospital and the employment placement service (Locum) Pearson had used to obtain his temporary placement there. Although Pearson was a nonsignatory to the contract between the hospital and Locum, he was bound by the arbitration clause within that contract, as he knowingly accepted benefits resulting from it. Additionally, the contract between Locum and Pearson stated that "[a]ny controversy or claim arising out of or relating to the interpretation, enforcement or breach of this agreement ... shall be resolved by binding arbitration." The causes of action against the hospital arose as a result of Dr. Pearson's being placed there by Locum, which was the purpose of the contract.
Pearson v. Hilton Head Hospital, No. 5036, is available online.
