Young Lawyers Division receives five ABA Awards of Achievement
Congratulations to YLD, winner of five prestigious Awards of Achievement at the American Bar Association Annual Meeting! The awards included first place for Minority Service Project, Service to the Public and Newsletters, and second place for Service to the Bar and Comprehensive Projects and Programs.
Public hearings for judicial candidates
Public hearings have been scheduled to begin Monday, November 12, regarding the qualifications of the candidates for judicial positions listed in this media release. Persons desiring to testify shall furnish written notarized statements of proposed testimony. These statements must be received by Tuesday, October 30, at noon. Statements should be mailed or delivered to the Judicial Merit Selection Commission as follows: Jane O. Shuler, Chief Counsel, 104 Gressette Bldg., P.O. Box 142, Columbia, SC 29202.
Nominating Committee to meet
The Nominating Committee will meet Sept. 18. The Committee will be nominating persons to fill the offices of President-Elect, Treasurer, Secretary, one member each of the Board of Governors for Judicial Regions 1 (Circuits 7, 10, 13 and 16), 2 (Circuits 5, 6, 8 and 11) and 3 (Circuits 3, 4, 12 and 15) and one State Bar Delegate to the American Bar Association.
Members of the Bar are encouraged to forward names to a Committee member for consideration for nomination to these offices. Names may also be forwarded to the Committee through Executive Director Bob Wells. Persons seeking office will be asked to submit materials to the Committee which demonstrate their leadership abilities in Bar activities and in other capacities in service to the legal profession.
The Committee members are Marvin Quattlebaum, Greenville, Chair; Doug Jennings, Bennettsville; Stuart Mauney, Greenville; Marie-Louise Ramsdale, Mt. Pleasant; Pamela Roberts, Columbia; Hal Strange, Georgetown; Hagood Tighe, Columbia; and Bruce Wallace, Charleston.

Columbia attorney elected to NCBP
Congratulations to Columbia attorney Lanneau Wm. Lambert Jr., who was elected secretary of the National Conference of Bar Presidents.
The S.C. Bar Trial and Appellate Advocacy Section is seeking nominations for its award, which recognizes a lawyer who has demonstrated outstanding commitment to trial and appellate advocacy in the legal profession. Secure passwords. Recently, it was rumored that Dropbox had been hacked again after several users were spammed. The Dropbox blog explained that hackers stole user login information from another website and were then able to access the Dropbox accounts of users who used the same login information for Dropbox. In this personal injury case involving colored contact lenses, the S.C. Supreme Court affirmed the Court of Appeals to the extent partial summary judgment was granted on claims that would impose common-law requirements "different from, or in addition to" applicable FDA requirements. The remaining causes of action were remanded for further proceedings consistent with the Court’s opinion.

This case addresses whether cellular service providers are included in the term “telephone company” for the purposes of increasing license fees. The Court reversed the Court of Appeals and reinstated the Administrative Law Court’s grant of summary judgment in favor of the petitioners. The Court found the term "telephone company" in a tax statute is ambiguous and any doubt must be resolved in favor of the taxpayer.

In this appeal from the Appellate Panel of the S.C. Workers' Compensation Commission (Appellate Panel), Rhame contended the Appellate Panel erred when it held that his claim was barred by the statute of limitations. The S.C. Court of Appeals dismissed the case as untimely pursuant to Section 42-17-60 of the S.C. Code (Supp. 2011) and therefore did not reach the merits of Rhame's arguments.
