Strom Thurmond High School wins state mock trial competition
Congratulations to the Strom Thurmond High School mock trial team, which will advance to the national competition in May! Bob Jones Academy placed first runner-up. Special thanks goes to the 2012 State High School Mock Trial volunteers. The mock trial program is made possible through an IOLTA grant from the S.C. Bar Foundation.
Nominations sought for Distinguished Lawyer Award
The Employment and Labor Law Section is seeking nominations for the Distinguished Lawyer Award, which recognizes meritorious service to employment and labor law practice in South Carolina. The 2012 recipient will be honored at the Section mid-year seminar, scheduled for May 18 at the Bar Conference Center in Columbia. Click here for the nomination packet. Paint and landscape with YLD’s Voices Against Violence Committee!
The YLD Voices Against Violence Committee needs volunteers to assist with painting and landscaping makeover projects at various domestic violence shelters throughout the state. If you can hold a paint brush or a garden tool, you are qualified to do the job! Donations of paint supplies, outdoor furniture and landscaping materials are also needed. Appointments to Commission on Alternative Dispute Resolution
Pamela E. Deal and the Hon. Patricia C. Grant have been appointed to the Commission on Alternative Dispute Resolution, with terms ending Sept. 1, 2014. Additionally, the following have been reappointed to the Commission with terms ending Sept. 1, 2014: Hon. Debora Faulkner, Hon. John D. Geathers and James W. Patterson.

The S.C. Court of Appeals reversed and remanded the family court’s order in which the husband was to pay alimony to the wife for consideration of potential social security benefits that the wife could be earning but had not tried to claim. The court further reversed the family court’s award to the wife of 40 percent of the marital estate because the husband made disproportionately greater contributions to the assets during the marriage. Consequently, an order of payment of the wife’s attorney’s fees was reversed. However, the court affirmed the family court’s valuation of an annuity fund and its use of an amended order instead of the final order.

In this appeal arising out of the trial court’s order denying a motion to compel arbitration, the court affirmed the trial court’s ruling that the Federal Arbitration Act did not apply to the parties’ employment agreement because their dispute did not implicate interstate commerce. While a precedent case was based upon a recruiting contract rather than an employment contract as in this case, the court found this error was not prejudicial.

In this dispute arising from a bequest in a will to establish a scholarship fund, the court affirmed the special referee’s rulings and held that there was no error in failure to consider extrinsic evidence because the issue was not preserved for appeal; there was no error in prohibiting testimony because it did not qualify as an exception to the hearsay rule; there was no error in refusal to make a factual finding because the will was unambiguous; the written beneficiary designation in the IRA Agreement did not satisfy the contemporaneous writing requirement; and the funds were correctly administered.
