Advance Sheet update

The S.C. Supreme Court dismissed this case as improvidently granted. The petitioner, an inmate at Ridgeland Correctional Institution, appealed the decision of the Court of Appeals finding that he is not an employee of Kwalu Furniture (Kwalu), a private sponsor, in a Prison Industry Enhancement Certification Program (PIECP); that he is not entitled to reimbursement of monies deducted from his gross prison industries pay for Victim Assistance programs; and that he is entitled to time-and-a-half pay for overtime hours he provided to Kwalu as part of the PIECP project.
SCDC v. Cartrette, No. 27094, is available online.
In this pension benefits case, the Court found that summary judgment was properly granted by the circuit court. The respondents successfully moved for summary judgment on the basis that the appellant could not establish the respondents’ willful and intentional disregard for the Court's order requiring past due benefits to be tendered. Because the underlying order and the Court's 1977 opinion do not unambiguously state the appellant is entitled to health insurance benefits, the appellant's mandamus and contempt claims were dismissed.
Knight v. Austin, No. 27095, is available online.
