Call for authors!
The South Carolina Lawyer is seeking authors to write articles that appeal to a broad range of lawyers. If you are interested in writing an article, view the Memorandum for Authors and submit a proposal to firstname.lastname@example.org. Authors may receive two MCLE credit hours for articles that are at least 2000 words in length.
Compliance reporting deadline quickly approaching
All active attorneys licensed before March 1, 2011, must file their 2011-2012 compliance reports with the Supreme Court Commission on CLE & Specialization on or before Thursday, March 1. Currently, less than 50 percent of Bar members have filed their reports. Reports can be mailed to the Commission at P.O. Box 2138, Columbia, SC 29202. Bar members may also hand-deliver (or overnight) their reports to the Commission’s office located at 950 Taylor Street, Ste. 120, Columbia, SC 29201. Reports postmarked after March 1 must include the late fee. Questions should be directed to the Commission at (803) 799-5578 or email@example.com.
New Ethics Advisory Opinions issued
The Ethics Advisory Committee has issued two new opinions. The text of all opinions is available here.
12-02 A contingent fee, payable to a lawyer as a partial ownership interest in real property with the client, may be permissible subject to the lawyer’s compliance with: Rule 1.8(a), regarding entering into business transactions with a client; Rule 1.8(i), regarding acquisition of a proprietary interest in the subject matter of litigation; Rule 1.5(c), regarding contingency fees; and Rule 1.5’s reasonableness requirement.
12-03 If a question-answering website complies with all communications and advertising rules, a lawyer may participate in such a program, but with specific caution against inadvertently forming an attorney-client relationship by offering more than basic information of general applicability.
However, a lawyer’s participation in a website that uses the word “expert,” invites specific questions about specific legal matters, and offers specific legal advice but uses buried small-type statements to attempt to disclaim the creation of attorney/client relationships is prohibited.

E-mail spam. Most people know that junk e-mail is also known as spam, and sometimes legitimate e-mails get caught in spam filters. Knowing why can help ensure your critical business e-mail won’t be thwarted before it reaches its recipient. Pay attention to the words used in your subject line. Certain words are known as “spam triggers” that will cause e-mail to be blocked by Internet service providers and anti-spam software.
