Courts to expedite appeals

The S.C. Supreme Court issued an order, which includes the Court of Appeals, that will expedite consideration for any appeal or petition for a writ of certiorari to the Court of Appeals from termination of parental rights proceedings, adoption proceedings and/or Department of Social Services actions involving custody of a minor child. The complete order can be viewed

The S.C. Supreme Court found that considering the record as a whole, there was substantial evidence that would allow reasonable minds to reach the conclusion that the petitioner should have known she had a compensable injury when first diagnosed with sarcoidosis. Based on that time, the petitioner's claim was barred by the statute of limitations. The Court declined to address the issue of compensability and causation.

Justice Beatty dissented in a separate opinion in which Acting Justice James E. Moore concurred.

Member discipline
By order of October 24 the Court imposed a public reprimand (with additional conditions) on Michael Langford Brown Jr. for misconduct which resulted in a guilty plea to resisting arrest. The conditions include compliance with the contract with Lawyers Helping Lawyers.

By order of October 24 the Court imposed a 60 day suspension on Thomas Maurice Gagne for misconduct which included a person in his office endorsing a settlement check without the client's express authority to do so, contacting former clients who had selected an associate who left the firm to handle their matters and assigning his paralegal to attend a deposition (leaving the initial appearance that the paralegal was a licensed lawyer in the firm).

By order of October 24 the Court disbarred Amanda Graham Steinmeyer (retroactive to December 2, 2010) for misconduct which included depositing a settlement in her personal account rather than the law firm trust account, having insufficient funds in her trust account, failing to maintain required records, providing false testimony to the Office of Disciplinary Counsel, paying non-client related expenses from a trust account, endorsing a client's name on a State Accident Fund check without the client's knowledge, pleading guilty to driving under the influence and completing PTI on other charges and failing to file an action in a dispute between neighbors.
