In this premises liability action, the S.C. Supreme Court adopted the balancing approach to determine foreseeability regarding a business owner’s duty to protect its invitees from criminal acts of third parties. The Court affirmed the Court of Appeals' decision upholding the circuit court's grant of summary judgment in favor of a motel and its franchisee when a guest was shot in the leg during an attempted robbery outside of his motel door. The petitioner did not provide the circuit court any evidence that the respondent's security measures were unreasonable given the risk of criminal activity on the property.

By order of October 5 the Court placed Terry Lance Carter on interim suspension.

By order of October 10 the Court disbarred John W. Harte Jr. (retroactive to Sept. 22, 2009) for misconduct which resulted in a guilty plea to conspiracy to commit mail fraud and money laundering.

By order of October 10 the Court imposed a 90 day suspension (with additional conditions) on Richard M. Lovelace Jr. for misconduct which involved slapping a defendant prior to beginning a deposition.

By order of October 10 the Court imposed a nine month suspension (with additional conditions) on Efia Nwangaza for misconduct which included failing to maintain contemporaneous time records in matters, billing for matters not contemplated in a fee agreement, failing to maintain proper trust account records and signing a client's name in a verification without the client's permission, then notarizing the signature.

By order of October 10 the Court imposed a two year suspension (with additional conditions) on Brian Charles Reeve for misconduct which included failing to keep his address current with the Bar, failing to adequately communicate with a client, failing to ensure a client file was returned and failing to respond to a notice of disciplinary investigation.
